1. Introduction

These Terms & Conditions govern the use of services provided by Aeronautica (Pty) Ltd (“the Company”, “we”, “us”, or “our”).

By engaging our services, you (“the Client”) agree to be bound by these terms.

2. Scope of Services

Aeronautica provides aviation-related services including, but not limited to:

  • Aircraft management

  • Charter coordination

  • Flight planning and clearances

  • Crew provision

  • Maintenance coordination

  • Regulatory compliance assistance

All services are subject to availability, operational feasibility, and regulatory approval.

3. Regulatory Compliance

All aviation services are conducted in accordance with:

  • South African Civil Aviation Authority (SACAA) regulations

  • International Civil Aviation Organization (ICAO) standards

  • Applicable airspace and jurisdictional laws

The Company reserves the right to refuse or cancel any operation that does not comply with safety or legal requirements.

4. Charter & Flight Operations

4.1 Third-Party Operators

Aeronautica may act as an intermediary between clients and licensed air operators.
We do not operate aircraft unless explicitly stated.

4.2 Scheduling & Delays

Flight times are subject to:

  • Weather conditions

  • Air traffic control

  • Aircraft availability

  • Technical or safety considerations

The Company is not liable for delays beyond its control.

5. Client Responsibilities

The Client agrees to:

  • Provide accurate passenger and flight information

  • Comply with all customs, immigration, and aviation regulations

  • Ensure passengers carry valid identification and travel documents

  • Adhere to safety instructions from crew and operators

Failure to comply may result in cancellation without refund.

6. Payments & Fees

  • All services are subject to quotation and acceptance

  • Payment terms will be specified per agreement

  • Additional costs may include:

    • Fuel surcharges

    • Landing and handling fees

    • Catering

    • International permits

Late payments may result in suspension of services.

7. Cancellations & Refunds

Cancellation terms vary depending on:

  • Aircraft operator policies

  • Timing of cancellation

  • Services already rendered

Non-refundable costs may include:

  • Permits

  • Crew positioning

  • Catering

  • Third-party fees

8. Liability

8.1 Limitation of Liability

To the fullest extent permitted by law:

  • Aeronautica is not liable for indirect, incidental, or consequential damages

  • Liability is limited to the value of the service provided

8.2 Third-Party Liability

Where services involve third-party operators:

  • Liability rests with the licensed operator

  • Clients may be subject to operator-specific terms

9. Insurance

Aircraft operators are required to maintain appropriate aviation insurance.
Clients are encouraged to obtain:

  • Travel insurance

  • Personal liability coverage

10. Force Majeure

The Company is not liable for failure to perform due to events beyond reasonable control, including:

  • Weather disruptions

  • Political instability

  • Airspace closures

  • Pandemics

  • Natural disasters

11. Confidentiality

All client information and flight details are treated as confidential unless disclosure is required by law or regulatory authorities.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
Any disputes will be subject to South African courts.

13. Amendments

Aeronautica reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of updated terms.
